1. Agreement to Terms
These Terms of Service (“Terms”) govern all services provided by Roland Outdoor (“Company,” “we,” “us,” or “our”) to you (“Customer,” “you,” or “your”). By scheduling, receiving, or paying for services, you agree to be bound by these Terms.
2. Scope of Services
Roland Outdoor provides lawn care, landscaping, and related outdoor services as described in written estimates, proposals, invoices, or service descriptions. Services include but are not limited to mowing, trimming, edging, debris removal, fertilization, and seasonal cleanup.
Services are limited to areas reasonably accessible and safe at the time of service. Any services not expressly listed are not included and may incur additional charges.
3. Scheduling & Weather Policy
- Service dates and times are estimates and may change due to weather, equipment needs, staffing constraints, or operational requirements.
- Weather, wet or unsafe conditions, extreme heat or drought may delay or reschedule service.
- Weather-related delays do not qualify for refunds, credits, or guarantees of exact service times.
4. Access to Property
Customers are responsible for ensuring safe and unobstructed access to the service area, including:
- Unlocked gates
- Pets secured away from service areas
- Lawns clear of debris, toys, hoses, or animal waste
If access, safety, or obstructions prevent service completion, the visit may be skipped and billed as scheduled.
5. Property Conditions & Damage Disclaimer
Roland Outdoor is not responsible for damage arising from:
- Hidden or undisclosed items such as sprinkler parts, irrigation lines, wires, rocks, or debris
- Pre-existing property conditions
- Uneven ground, soil conditions, erosion, or conditions outside the Company’s control
Minor turf marks, discoloration, or equipment tire marks are considered normal risks of service.
All damage claims must be reported within 48 hours of service completion. Claims reported after this period may be denied.
6. Pricing, Payments & Billing
- Pricing is based on the property condition and services requested at the time of estimate.
- Payments are due upon receipt unless otherwise agreed in writing.
- Recurring services may be billed automatically.
- Late payments may result in late fees, service suspension, or collections.
- Failed or declined payments may incur processing fees.
All completed services are non-refundable unless otherwise specified.
7. Recurring Services & Cancellations
For ongoing or recurring services:
- A 48-hour notice is required to cancel, pause, or reschedule service.
- Services canceled without sufficient notice may still be billed.
- Skipped services due to lack of access or customer requests are not automatically credited.
Seasonal or subscription services may carry minimum service commitments.
8. Estimates & Scope Adjustments
Estimates are based on visible property conditions. Roland Outdoor may adjust pricing if:
- Lot size or property conditions differ from the estimate
- Scope of work changes
- Additional labor, equipment, or materials are required
Customers will be notified of material pricing changes when reasonably possible.
9. Communication Consent
By engaging services, you consent to receive communications from Roland Outdoor via phone, text, or email regarding:
- Scheduling
- Service updates
- Billing and payments
- Customer support
Communication frequency may vary. You may opt out of non-essential communications at any time.
10. Limitation of Liability
To the fullest extent permitted under Missouri law:
- Roland Outdoor shall not be liable for indirect, incidental, consequential, or special damages.
- Total liability for any claim related to services shall not exceed the amount paid for the specific service giving rise to the claim.
11. Indemnification
The Customer agrees to indemnify and hold Roland Outdoor harmless from claims, damages, losses, or expenses arising from:
- Unsafe or undisclosed property hazards
- Customer negligence
- Failure to prepare property for service
12. Governing Law & Venue
These Terms shall be governed by and construed under the laws of the State of Missouri. Any legal action or dispute will be brought in courts located in Missouri.
13. Modifications to Terms
Roland Outdoor reserves the right to modify these Terms at any time. Continued use of services after modifications constitutes acceptance of the updated Terms.
